Investigate Before Buying a Condo or Townhouse photo

Many people in all phases of life situations find the lifestyle of condo or townhouse living to be a great fit.? The prices for first time home buyers are affordable and allow them to begin establishing credit for larger future purchases.? Price and ease of social interaction appeal to those who are separated or divorced. Boomers wishing to downsize, but prefer living in a non-homogenized community, find them most desirable.

A wonderful lifestyle awaits those who buy into this type of development.? The difference between a smooth successful transaction and a dreadful failure can be avoided by you and your Realtor doing some investigating before you fall in love with a particular unit.

If you have decided that condo or townhouse living is something you would like to pursue, do not begin your search by shopping for individual units on the internet. ?Photographs of the interiors of condos or townhouses tell only a very small part of the story of how it is to live there.? Make more of a global decision which areas interest you.? Then drive around and observe the developments as a whole and courts or streets in particular.

Make a mental note of these important items:

  1. Are the common grounds well maintained?
  2. Are the exteriors of the buildings in states of disrepair or are they updated?
  3. Do the residents of certain sections seem to have more pride of ownership than others?
  4. If properties for sale back up to the main road, what kind of a buffer has the association provided to block out the noise from traffic?

Talk to residents about the plusses and minuses of living there.? Let them do most of the talking without you guiding them toward answers they think you might want to hear.

After you have made a plan and given yourself the choice of a couple of developments, then you can begin your online search viewing specific homes.? If you find some units that interest you, then you need to start your ?behind the scenes? investigation of the association in particular and the development as a whole.? Here are things you need to find out and why:

Are there any pending lawsuits or liens against the association?
Accidents can happen at any time.? This is why associations have insurance.? But if an association has a law suit pending the bank may not lend you the money to buy in that development until the law suit is settled. An association that is not fiscally sound could send your hard earned investment into downward spiral.

What is the percentage of investor owned units?
Banks have a threshold of allowance for condo and townhouse developments that have units not owner occupied.? Every bank is different but usually it is around 30%.? You could find after selecting the unit you wish to buy that the development has a higher percentage of condos or townhouses investor owned and rented.? You then may not be able to obtain a mortgage no matter how strong a buyer you are.

FHA financing
FHA financing is enticing these days to buyers.? The rates and terms are excellent and fees reasonable, making home ownership possible for many that cannot afford conventional loans.? But in the case of townhouse and condominium developments they must be approved for FHA financing.? This is a process for which the condo or townhouse association must apply and reapply when necessary to continue its status.? If a particular development on which you have your heart set is not FHA approved, you will not be able to apply for an FHA mortgage.

Is the association fiscally sound?
An association that is financially struggling to keep up with the maintenance and needed improvements will begin to show.? It may have a pool, but can?t afford to open it.? It could have tennis courts but they are in such disrepair they cannot be used.? If you are looking in a development after the pool and/or clubhouse are closed, you need to find out if these things were in fact open and operating well during the summer season.? All of these factors contribute not only to your enjoyment of living in a community, but will affect your return on investment when you wish to sell.? A development that has not been carefully maintained lowers everyone?s property value.

The answers to all of these questions can be answered by speaking to the appropriate people beforehand.? Both you and your realtor can find out the name and phone number of the association and ask the pointed questions.? When banks make decisions on whether or not to lend money to home buyers they review a questionnaire filled out by the Association with exactly the answers to these questions.

In addition it is crucial that you see and actually read a copy of the association rules and regulations.? I know it is no 50 Shades of Gray reading material, but you need to know before you buy if you can live with the restrictions.? Here are some examples that could impact your life:

  • Pets ? May or may not be permitted.? If dogs are allowed there may be a restriction on size.
  • Parking ? Trucks or vans may not be permitted to park in the development.? If you have one, you may have to have alternate arrangements to park somewhere else.? Also in general is the parking situation a free for all or are there assigned parking spaces.
  • BBQ Grills ? Many do not permit gas or charcoal grilling.
  • Gardening ? You may or may not be permitted to plant flowers, shrubs or other vegetation.
  • Decks or Patios ? You may or may not be permitted to add one or the other.
  • Window Treatment Restrictions ? Some associations require that all window treatments used have white liners to give the exteriors a uniform appearance.

The list could go on and on.? While you may or may not agree, with them, they are the rules and you need to decide if you can live by them.? Successful associations have stricter guidelines in place not to annoy or police its residents, but to help retain and improve the values of the homes within the developments.

Can you think of anything worse that finding something you truly want, making plans toward that goal and then learning you can?t have it through no fault of your own?? Maybe it is moving into a development and afterwards finding out that the restrictive covenants do not fit with your lifestyle. Either of these scenarios could have been prevented with a little effort and exploration.

One final note about condo and townhouse living.? It is a wonderful concept when it is working the way it was designed.? All the homeowners share in the expense of the building exterior updates and common ground maintenance through a monthly fee.? It is the homeowners that do in fact have a voice in how things are done.? But to have that voice you need to be involved on a regular basis; not just that one time when you want something in particular.? Get involved.? It is yours and everyone else?s major investment at stake.? Protect it.

teethAs a child, I can?t tell you how many times I heard that question. As a parent, I can?t tell you how many times I?ve asked that question.

Over the years, dentists have done a fantastic job of raising awareness of the importance of preventative dental care. They give us tooth brushes and dental floss after each and every visit. They schedule appointments with us every six months to check our teeth and reinforce the importance of preventative dental care.

It wasn?t always that way. Dentists used make a living pulling teeth ? not preserving them. But over the last half century, the dental community has changed the way we view preventative dental care. Plus, those of us fortunate enough to have dental insurance often paid little to nothing out-of-pocket for preventative dental services.

So how can the health care system ? more specifically, how can health care professionals ? learn from the dental profession?

First, we should learn to value preventative services.

At this time of year, every physician, pharmacist and nurse should be asking each individual, ?Have you had your flu shot yet?? As patients, we should grow as tired of that question as kids have grown tired of parents asking them if they have brushed their teeth.

Influenza rapidly spreads around the world in seasonal epidemics and imposes a considerable economic burden in the form of hospitalizations and other health care costs and lost productivity. In the US alone, recent estimates put the cost of influenza epidemics to the economy at $71 to $167 billion per year.

And, the impact of influenza outbreaks can largely be controlled with a simple, affordable and readily accessible solution: the flu vaccine. It is one of the most preventable diseases and virtually everyone should get immunized against influenza.

Hospitalization and deaths mainly occur in at-risk groups (elderly, chronically ill and young children). Although difficult to assess, these annual epidemics are thought to result in between three and five million cases of severe illness and between 250,000 and 500,000 deaths every year around the world.

So, have you had your flu shot yet?

A study conducted by the Centers for Disease Control and Prevention (CDC) has put a dollar figure on visits to doctor?s offices and emergency rooms for the treatment of flu-stricken children. The study also looked at the amount of time parents have to miss work and care for little ones while they recover. The study found that parents had medical expenses ranging from under $300 to about $4,000 and missed between 11 and 73 hours of work, depending on whether their child was able to recover at home or was hospitalized. Most of these illnesses and costs are entirely and completely preventable.

Those of us who are parents know that kids are veritable germ factories. So, has your kid had his/her flu shot yet?

Several years ago, public health workers noticed that pharmacists had a significant impact on improving influenza immunization rates in states which allowed pharmacists to provide immunizations. Now, pharmacists in all 50 states can administer the influenza vaccine. According to the American Pharmacists Association, more than 20 million individuals are immunized by pharmacists against the influenza virus.

As we have discussed in this blog, pharmacists are America?s most accessible health care professional. Almost every community has access to a community pharmacy. There is usually not a wait in pharmacies to receive the vaccine and patients usually don?t have a schedule an appointment. The flu shot is relatively inexpensive ($20-$25) and is often covered by health plans.

There are few legitimate reasons not to get immunized against influenza this year. Talk to your family physician, pediatrician or pharmacist about getting the flu shot soon.

Still, more has to be done to raise the awareness level of the general public of the importance of preventative health care services like the influenza vaccine. Maybe, beginning every fall, we need every health care professional to start asking the question, ?So, have you had your flu shot yet??

Kate Murphy photo ? Cancer has enriched my life. I look forward to each day with its special joys and new possibilities. I have learned to live completely and fully. And I hate to leave this life behind now that I?ve found it. ? Kate Murphy, 1997.

The light dimmed a little today in the world of cancer research and patient advocacy. With deep grief but also gratitude for her life?s work, we report the passing of Kate Murphy, age 70, today (Oct. 3). While living 29 years with multiple Lynch-associated cancers and multiple sclerosis, she became one of the most respected patient advocates in the nation.

Kate was rare: She could knowledgably discuss cell-level biochemical pathways with world-renowned scientists; spin out concise, accurate reports all day long at a national oncology conference; and then, late at night in her hotel room, log onto an online cancer group and reassure a frightened, newly diagnosed patient with a blazingly clear summary of what steps should come next.

Diagnosed with her first (colon) cancer in 1983, Kate got her first modem in 1995 and within a month of its founding, joined the ACOR (Association of Cancer Online Resource) colorectal cancer group. In recent years she became the ?list mom,? monitoring and frequently dipping into the online chats with carefully scientific yet compassionate explanations of everything from new drugs to complementary medicine to day-to-day symptom survival tips.

Kate was in the first group of Colon List members who joined forces to found the Colon Cancer Alliance in 1999, and in 2005 she was on the founding team of Fight Colorectal Cancer, where she worked as Director of Research Communications right up until her death. She often said, ?Knowledge can break the desperate cycle of helplessness and hopelessness? for patients and families.

She didn?t just bring knowledge to patients; she took the patients? perspective back to the professional and scientific community. She served on many scientific committees which reviewed grant proposals, monitored patient safety and developed clinical trial concepts (a partial list of her affiliations follows this article). Her work with these committees was deeply respected by both patients and experts.

?Kate speaks when she has something to say, and people always want to hear what she has to say,? said Dr. Joel Tepper, former co-chair of the National Cancer Institute?s GI Steering committee, on which Kate served and which sets national research priorities for colorectal cancer and approves all Phase III and large Phase II trials for federal funding.

?I was always happy to see her in the room, as it meant that important patient issues would not be missed, and Kate could be trusted to get to the heart of important matters.?

Not only her voice and presence, but also her writing made an enormous contribution. As FCRC?s Director of Research Communications, Kate wrote for patients, both online and in print. She began the FCRC Research News blog in 2005 and wrote literally hundreds of news reports. Her mission: get the latest, most accurate news about CRC to patients and practitioners alike. But rather than simply use media reports, she spent hours reading the original, peer-reviewed journal articles. With her decades of experience, she could instantly tell whether a research report was practice-changing, an incremental step forward, or scientifically weak?and then translate it into accurate lay language, knowing exactly what patients, families, community practitioners needed to know.

Kate had a whole other side to her life. ?Many in the cancer community don?t know that Kate was also a published poet, or that she and her husband Tom took in rescue dogs. Kate was also a swimmer and in the summer, swimming in her lake brought her much joy. And her granddaughter Sophia was a gift who made her smile constantly,? says Nancy Roach, founder of Fight Colorectal Cancer. ?I will miss her smile and the twinkle in her eyes.?

?One of my favorite things about Kate was how much she loved to take train trips with her husband,? said Carlea Bauman, President of Fight Colorectal Cancer. ?And I mean LONG train trips. She once took the train from her home in upstate New York to the GI Cancers Symposium in San Francisco.

?Kate realized that the joy was in the journey ? and she was in no mood to rush to the finish line.?

Her scientific mind and her giant heart are stilled and cannot be replaced. But her voice carries on through every person she supported, inspired, and touched.

If you wish to honor Kate Murphy?s contributions to science, one of her favorite causes was Fight CRC?s Lisa Fund, which directs 100% of donations to young researchers working to find cures for advanced colorectal cancer.

Hey, relax Browns coaches and administrators, you?re not all fired.

At least not until the end of the year, anyway.

New Cleveland owner Jimmy Haslam has said he?ll wait until after the season to consider any staff changes, according to Mary Kay Cabot of the Cleveland Plain Dealer.

Haslam, who will be approved later this month as the new owner, said via team spokesman Neal Gulkis that personnel changes were ?not something we?ll discuss until after the year.?

That didn?t seem to be much of a relief to coach 0-4 Pat Shurmur.

?Right now, we?re trying to get our first victory [Sunday against the Giants],? Shurmur said. ?That?s my focus right now.?

Haslam was at practie Thursday, and said he wanted to take his time before proceeding.

?Look, we?re coming into this in the middle of the season,? he said. ?It?s an awkward time. We?re going to study and evaluate. . . .

?I don?t think anybody thinks 0-4 [is acceptable] and certainly [president] Mike Holmgren and Pat Shumur don?t think it is, and we don?t think it is. But we?ve got a young team. We?re building. I think we?re heading in the right direction.

?We don?t officially own the team yet, and we?ve said all along that we?re not going to make any comments on personnel until after we own the team. That?s in about two weeks. And, candidly, we?ll be halfway through the football season then, so any personnel decisions we?d make would be toward the end of the year.?

Haslam?s expected to bring former Eagles team president Joe Banner as soon as the ink?s dry, giving this season a ?dead man walking? appearance for Shurmur and Holmgren.

But Holmgren is apparently feeling no pressure, as he said ?I?m doing great,? before leaving the practice facility on his Harley-Davidson.

If nothing else, he has a few more months to look for an appropriate sunset to ride it into.

Real Estate: What To Watch Out For | Stuff.co.nz

Imagine finally selling your house and then finding out as you toast your success that your real estate agent wasn't really an agent at all.

That happened recently to a couple in the South Island town of Gore. For a $500 selling fee, Ewen McLeod took would-be purchasers through homes, put his number on advertising and drew up sales and purchase agreements. But he never had a licence as required by law.

This month in the Gore District Court, McLeod was found guilty of operating as an unauthorised agent and is yet to be sentenced.

Real Estate Agents Authority chief executive Kevin Lampen-Smith said unlicensed trading was a serious offence because consumers don't have any comeback through the authority's complaints process.

Legislation covering real estate agents was tightened in 2008. Most agents are following good practice but John Gray, president of the Home Owners and Buyers Association, says there is ''always the odd rogue out there''.

''There are many real estate agencies who are putting in a lot of effort to educate their agents as to the new world that exists now...but unfortunately there are those who are finding it hard to break old habits.''

If you're buying or selling a house, here's some things to watch out for:

Disclosure

Some of those old habits lie in the murky areas of disclosure and misrepresentation. It's no longer good enough for an agent to blithely parrot what a vendor says.

Last year two Nelson agents were found wanting by the regulator because they mistakenly advertised a property as being architecturally designed - a fairly common complaint.

Gray also finds some agents can still be a bit ''over-exuberant'' about aspects of construction that they don't know enough about.

''Primarily that's plaster homes, and we see agents advertising the fact they have a [ventilation or drainage] cavity, when we find in most cases the agents wouldn't know what a cavity looked like.''

Previously, an ethical agent who suspected the property had failings might have advised the would-be buyer to ''get the place checked out''. ?But under the new rules, an agent only has to suspect that something is wrong and they are obliged to ask the vendor about it - and tell prospective buyers.

And if an agent suspects that the vendor is keeping something back, they must actually end the deal.

Real Estate Institute Wellington spokesman Euon Murrell says agents are certainly being more cautious.

''We are more conscious of being correct so we are obliged to find out more information then we used to, and we are being asked to even interpret titles, which I have to say is a bone of contention because we're not lawyers.''

Disclosure takes many forms. It also relates to whether the agent or anyone they know is interested in the property themselves.

A recent case down south involved an agent as purchaser from the same agency as the selling agent. The deal happened quickly and an aggrieved consumer who missed out smelled a rat.

However, the complaint was dismissed because they had been completely transparent with the owner. ?

Undue pressure

A frequent complaint to the REAA is from clients who claim they were pressured to sign without time to get legal advice.

''One of the things that we're seeing is agents preparing sales and purchase agreements in advance with conditions struck out and little stickers put on,'' says Gray.

''They present these contracts as almost a fait accompli to prospective purchasers and we are warning purchasers not to accept the additional conditions or the strike-out of existing conditions in the standard sales and purchase agreements just because that's the way it's presented.''

Commissions and licences

One of the worst cases of misconduct was heard in July. The agent used a relation or associate to buy properties and then onsold them at a higher price, secretly pocketing the difference.

Not only did he fail to disclose that fact to the real vendors and purchasers, but he then inflated the prices on the later sales and purchase agreements to deceive the banks into offering 100 per cent finance to the buyers.

He forged signatures, inserted material, and in one case, had his client sign two blank sale and purchase agreements, forcing the client into a second purchase without his knowledge.

In this way, the agent and his associates reaped $189,000 from their offences, while the agent still got thousands in commissions.

Obama was holding a Friday rally in Cleveland and then heading to California for a fundraising spree beginning Sunday that will include a concert in Los Angeles featuring Jon Bon Jovi, Katy Perry and Stevie Wonder.
