Alabama judge removed over Ten Commandments fight to run again (Reuters)

MOBILE, Ala (Reuters) ? A former Alabama Supreme Court chief justice who was famously booted from his post for refusing to remove a Ten Commandments monument from a state courthouse said on Tuesday he would run again for his old job.

Roy Moore, 64, announced his bid ahead of a March 13 Republican primary from the steps of the Alabama Judicial Building in Montgomery, the same building in whose rotunda he placed a 5,280-pound granite monument of the biblical codes shortly after he was elected chief justice in 2000.

The installation drew intense opposition from proponents of the separation of church and state, and resulted in a legal challenge.

A federal judge ultimately ruled the chief judge was placing himself above the law and violating the U.S. Constitution by refusing to remove the monument, and Moore was removed from the state's high court in 2003.

Moore has since mounted two unsuccessful gubernatorial bids in Alabama, failing both times to win the Republican nomination, and in June abandoned pursuit of a possible presidential bid.

He has spent most of the past eight years on the lecture circuit and penned a book, "So Help Me God: The Ten Commandments, Judicial Tyranny, and the Battle for Religious Freedom."

He also founded the Montgomery-based Foundation for Moral Law and currently serves as the nonprofit's president. On its website, the foundation lists a two-fold mission to represent "individuals involved in religious liberties cases" and to "teach the necessity and importance of acknowledging God in law and government."

Moore faces current Chief Justice Chuck Malone and former Alabama Attorney General Charlie Graddick in the Republican primary. There currently are no Democratic or independent candidates in the race.

NEW YORK (AP) ? Ryan Braun sat alone on a balcony in his Malibu home that overlooks the Pacific Ocean, uneasy about his chances of winning the NL Most Valuable Player award.

With the season Los Angeles' Matt Kemp had, he wasn't sure the call would come at all.

The phone rang all right, and Braun has been smiling ever since.

Braun was voted the NL MVP after helping the Milwaukee Brewers win their first division title in nearly 30 years.

"I'm not going to pretend like I wasn't anxious or nervous because I was," Braun said. "It's honestly difficult to put into words how much this means to me."

The left fielder received 20 of 32 first-place votes and 388 points in voting announced Tuesday by the Baseball Writers' Association of America.

A nerve-racking morning that began with a solitary drive turned to elation in the California sun.

The 28-year-old Braun shared the news with his brother and girlfriend, who were at the house. He called his parents, then rang good friend Aaron Rodgers, the Green Bay Packers quarterback, and exchanged text messages with Kemp, the runner-up.

"This really is a dream," Braun said. "This is beyond my wildest dreams to be in this position at this point in my career."

Kemp earned 10 first-place votes and 332 points after coming close to winning the first Triple Crown since Carl Yastrzemski in 1967. Braun's teammate Prince Fielder finished third with 229 points, and Arizona's Justin Upton finished fourth with 214 points. Fielder and Upton each received one first-place vote.

St. Louis' Albert Pujols finished fifth. It was the 11th straight year the three-time MVP was in the top 10 in balloting.

NL Cy Young Award winner Los Angeles' Clayton Kershaw was 12th in the voting a day after Detroit's Justin Verlander added the AL MVP to his Cy Young.

"I think he was the single most dominant player in baseball this year," Braun said of Verlander. "As a position player I'm biased to the fact that I think position players should be at the forefront of the award, but if you honestly look at what he accomplished, how much he meant to that team and how dominant he truly was you cannot make any argument against him winning that award."

In his fifth year in the big leagues, Braun led the NL with a .597 slugging percentage and had a chance to overtake Jose Reyes for the batting title on the last day of the season but finished second with a .332 average. The four-time All-Star had 33 homers, 111 RBIs, 109 runs scored and stole 33 bases as Milwaukee won a franchise-best 96 games. His 77 extra-base hits was tops in the league.

Kemp led the NL with 39 homers, 126 RBIs and was third in average (.324), but played for the NL West's third-place Dodgers. He also won a Gold Glove.

"Matt's one of the best players in the game. No question about it. The season he had will go down as one of the greatest in Dodgers history," said Braun, who grew up in California rooting for the Dodgers. "If he had won the MVP I certainly couldn't have argued with him winning. He had a phenomenal year."

Although Braun and Kemp had similar statistics, Kemp was hindered by the Dodgers' 82-79 third-place finish in the NL West. The Brewers won the NL Central title, their first division crown since winning the AL East in 1982.

"Without a doubt I think it's a drastically different experience playing meaningful games down the stretch," said Braun, the 2007 NL Rookie of the Year.

Braun, in fact, was convinced the Brewers' first-place finish is what put him over the top with voters.

"If you honestly assess both of our seasons individually I think his numbers are probably better than mine, and I just feel fortunate to have been on the better team," Braun said. "It's an individual award, but it's a result of being part of a special team, a special organization."

Braun is the first Brewers player to win the MVP award in the National League and first since Robin Yount won in 1989, when Milwaukee was in the AL East. Rollie Fingers (1981) and Yount in 1982 are the other Brewers to take home MVP honors.

"Robin's the greatest player in Milwaukee Brewers history, so anytime you're mentioned alongside him it's a tremendous achievement," Braun said.

Braun signed a $105 million, five-year contract extension in April, linking him to the Brewers through 2020. He received a $100,000 bonus for winning the MVP.

''This team has been so loyal to me. They believed in me. They drafted me. They helped to develop me, and there would be nothing more meaningful to me than to eventually win a world championship in Milwaukee," he said. "It would mean a lot more to me than if I went to a large-market team, big-market-team and won two or three championships."

We worry about, but don't budget for, holidays

Very few shoppers set a strict holiday budget, according to a new survey.

Given the state of the economy, it comes as no surprise that many Americans are worried about how they?ll be able to pay for all their holiday expenses.

The trouble is, most of us don?t seem to be doing much to plan for it.

A new survey from the National Endowment for Financial Education finds that just 31 percent of consumers plan to set a budget this holiday season. That?s only slightly more than last year, when 27 percent said they were making a budget.

The vast majority said they weren?t going to set a holiday spending budget. Still, only 10 percent said they often spend more than they want to. That?s about the same as last year.

The wealthier the household, the less likely they were to set a budget.

Half of the people NEFE surveyed said they were more worried about being able to afford holiday expenses than they were five years ago. Nearly 4 in 10 are just as concerned about holiday spending as they were five years ago.

Harris Interactive conducted the survey of about 2,800 adults earlier this month on NEFE?s behalf.

3 American students arrested in Egypt's Tahrir Square

Three American students were arrested Monday evening during protests in Tahrir Square, a spokeswoman for The American University in Cairo told NBC News.

Luke Gates, a student at Indiana University from Bloomington, Ind., Gregory Porter, a student at Drexel University from Glenside, Pa., and Derrik Sweeney, a student at Georgetown University from Jefferson City, Mo., are being held at the Abdeen police station in Cairo, reported NBC.?

The three are currently studying abroad at The American University in Cairo. University spokeswoman Morgan Roth said the university is in?"fact-finding mode" about the detentions at the moment.

"I don't have specifics on the charges they are facing or if they have been formally charged. I just know that they are being detained," Roth told NBC.?The American University is working with the U.S. Embassy in Cairo to monitor the students' well-being, she said.

NBC's Richard Engel said Egyptian television was reporting three American citizens were arrested after being seen throwing fire bombs from the roof of a building belonging to the American University near Tahrir Square, and that the U.S. Embassy was investigating.

The State Department has not yet been able to gain consular access to the students.

The students' parents were notified Tuesday morning of the arrests. Drexel University, Gregory Porter's school, released a statement saying "administrators are in contact with Porter's parents and are working with authorities at the American University in Cairo and the U.S. Embassy to have Porter released and returned home safely."

The two other students' universities have been notified of the arrests as well.

Meanwhile, Egyptians converged on Tahrir Square on Tuesday in response to a call for a so-called "million-man march" as protests against the country's military rulers entered a fourth day. Read full coverage here.

Penn State picks ex-FBI chief for internal inquiry

Former FBI director Louis Freeh, tapped to lead Penn State's investigation into the child sex-abuse allegations against a former assistant football coach, said his inquiry will go as far back as 1975, a much longer period than a grand jury report issued earlier this month.

Freeh was named Monday to oversee the university board of trustees' internal investigation into the abuse allegations that ultimately led to the ouster of longtime football coach Joe Paterno and university President Graham Spanier.

Freeh said his goal was to conduct a comprehensive, fair and quick review. His team of former FBI agents, federal prosecutors and others has already begun the process of reading the grand jury report and looking at records.

"We will immediately report any evidence of criminality to law enforcement authorities," said Freeh, who has no direct connection to Penn State.

Penn State has faced criticism since announcing that its internal investigation would be led by two university trustees, Merck pharmaceutical company CEO Kenneth Frazier and state Education Secretary Ronald Tomalis.

Former student: Sandusky he knew is not a 'monster'

Faculty members on Friday called for an independent investigation of how the university handled abuse allegations, and the faculty senate endorsed a resolution asking for an independent investigation.

In announcing Freeh's appointment, Frazier stressed the former FBI director's independence. Freeh will be empowered to investigate employees up to and including the board of trustees itself, Frazier said.

"No one is above scrutiny," Frazier said. "He has complete rein to follow any lead, to look into every corner of the university to get to the bottom of what happened and then to make recommendations that will help ensure that it never happens again."

Freeh said he had been assured there would be "no favoritism." He called that assurance "the main condition of my engagement."

Second nonprofit sent kids to Sandusky charity

Former assistant football coach Jerry Sandusky is accused of molesting eight boys over a 15-year period beginning in the mid-1990s. Authorities say some assaults happened on campus and were reported to administrators but not to police.

Authorities say Sandusky, who retired from Penn State in 1999, met the children through The Second Mile, a youth charity that he started in 1977. By going back as far as 1975, Freeh's investigation would cover the entire time The Second Mile has existed and 24 of the 30 years that Sandusky worked at Penn State.

Amid the scandal, Penn State's trustees ousted Spanier and Paterno. The trustees said Spanier and Paterno failed to act after a graduate assistant claimed he saw Sandusky sexually abusing a young boy in a campus shower in 2002.

Sandusky to NBC: "I am innocent of those charges"

Paterno, who has the most wins of any major college football coach, has conceded he should have done more. Spanier has said he would have reported a crime if he had suspected one had been committed.

Sandusky has said he is innocent. He has acknowledged he showered with boys but said he never molested them.

Former school administrators Tim Curley and Gary Schultz are charged with not properly alerting authorities to suspected abuse and with perjury. They maintain their innocence.

Freeh founded an investigation firm, Freeh Group International Solutions, after leading the FBI from 1993 to 2001. He previously served six years as a special agent.

After his time at the FBI, Freeh also did work for credit card giant MBNA, which has business relationships with Penn State and its alumni association. But a spokeswoman for Freeh's investigation said in a statement that it would not compromise the probe. The statement said Freeh has "no previous personal connection to Penn State" and had no role in negotiating MBNA's longstanding business deal with the school.

Sandusky charity faced contempt motion

Freeh's law firm was hired to look into the bribery case involving FIFA's presidential election. Soccer's governing body banned candidate Mohamed bin Hammam for life for bribing voters. The ruling body also banned 11 Caribbean soccer leaders and disciplined others in the corruption scandal.

Freeh said he spoke with Pennsylvania Attorney General Linda Kelly on Sunday night and was determined not to interfere with the ongoing criminal case. A spokesman for Kelly said she was aware of the Penn State trustees' special committee, but declined comment about it.

Gov. Tom Corbett called Freeh's selection "a good one," noting his familiarity with grand juries and the role of prosecutors.

Rod Erickson, Penn State's new president, also lauded the selection. He vowed complete cooperation and said Freeh's findings "will prompt immediate actions for which I will remain responsible."

Freeh will report to a special committee comprised of six university trustees; Dan Hagen, chair of the university's faculty senate; Rodney Hughes, a doctoral student in higher education at Penn State; and retired Air Force Col. and astronaut Guion Bluford, a 1964 Penn State graduate.

Officials also announced that anyone who has information related to the probe can contact investigators at a telephone hotline - 855-290-3382 - and a special email, PSUhelp(at)freehgroup.com.

Meanwhile, Penn State police have referred a report of an indecent assault at an outdoor swimming pool building to the attorney general's office.

A police log noted the report referred to an incident that occurred sometime between June 1, 2000, and Aug. 30, 2000. The report was made to campus police Wednesday and was noted on Thursday's police log.

When asked if the report was related to allegations against Sandusky, Penn State Police Chief Tyrone Parham said Monday: "We can never describe anything related to a victim or suspect."

State open records laws do not require Penn State to release the full police report.

A state lawmaker who represents the State College area said he was sponsoring a bill that would reverse the exemption - which currently applies to Penn State and three other universities that rely heavily on state funding but are independently run.

Rep. Kerry Benninghoff said a "more open climate" might prevent future scandals.

Chinese left guessing over high speed rail crash (AP)

SHANGHAI ? The investigation into a bullet train crash in China last summer that killed 40 people has come and gone with scarcely any fresh information released about what led to the disaster.

The secrecy surrounding the investigator's report, originally due in September and reportedly extended until late November, is typical of the sensitivities shown toward wider troubles plaguing the showcase high-speed rail program.

The accident inflamed public criticism over whether the powerful Railway Ministry was sacrificing safety in its costly quest to quickly roll out the bullet train network. Shortly after the July 23 crash, Premier Wen Jiabao called for a sweeping and transparent investigation,

Regulations on major transport accidents called for a report on the accident by Nov. 20, according to state media reports. Railway Ministry officials refused comment Tuesday.

The few slivers of information about the probe have been quickly recanted.

A railway expert and deputy director of the investigation team, Wang Mengshu, backtracked from comments published Monday in the state-run Beijing Times newspaper that quoted him as saying the accident near the eastern city of Wenzhou largely resulted from mismanagement.

State media on Tuesday carried reports of Wang claiming he was misquoted, that his comments were only his personal opinion, and that he was not authorized to speak to the media.

"I was not involved in the whole investigation. I did not have a general idea of the whole thing, and I did not know whether the conclusion had been submitted," Wang told state-run CCTV.

Wang did not respond to calls and e-mailed requests for comment.

In comments posted on the government work safety administration's website, Wang promised full and accurate disclosure of its findings.

The lack of transparency has left some in China skeptical that problems with the high speed rail network are being resolved, said Li Hongchang, an economics professor at Beijing Jiaotong University.

"People want not just the report but to understand how it was compiled. Openness and credibility are actually more important than the report itself," Li said.

Shortly after the accident, authorities blamed problems with the high-tech signaling systems used to run and route the trains for the crash, which occurred after railway staff failed to notice anything amiss when a lightening strike stalled a train and the signaling system failed to turn red.

But they have since backed away from that finding. The Beijing Times report quoted Wang as saying that given the lack of problems with the same signaling systems on other lines, the crash occurred mainly because of human error.
